La irrupción de las Patentes de material biológico desequilibra los principios de la UPOV. Por eso Fitó está buscando el compromiso que le permita respetar esos principios a la vez que los principios de la propiedad Industrial protegida por Patentes. La ILP propone acordar un marco de licencias de patentes entre empresas que, a su vez, respete los principios de  la UPOV y defendidos por Fitó.
