Financing the Seed Regulatory Program in Indiana:
Prior Indiana Law only allowed fees to be increased with an act of the Indiana General Assembly. This new law will allow the Seed Commission to adopt rules to finance the office of the Commission.
The State Seed Commission will publish "Notice of Intent to Adopt a Rule"on May 15, 2010 which is the first step to notify the public and industry of the process. Open meetings will be conducted with participation by interested parties before any new fees may be enacted by the Office of State Chemist and Seed Commissioner. Once this process is complete the new fee schedule would be adopted with an effective date of July 1, 2011. ISTA will keep you posted as the timeline changes and the steps involved in the process.
1. Provides the seed commissioner the authority to adopt rules to establish fees necessary for the administration of the Act, including costs of inspections, analysis and publications.
2. Provides the seed commissioner the authority to adopt rules to establish penalties for failure to submit reports and pay fees required by the Act.
"The state seed commissioner shall adopt rules under IC 15-15-1-27(b)(18) that concern IC 15-15-1-32 and IC 15-15-1-33, both as amended by this act, before July 1, 2011.(b) A rule adopted under this SECTION must take effect on July 1, 2011."
Special Use Permit:
1. Defines "special use permit"
2. Provides the seed commissioner the authority to receive petitions for special use permits for using "prohibited noxious weeds" and/or "restricted noxious weeds" as defined by the law for purposes of research, education, development or production.
