After four years of debate, the UPOV Council, adopted the new Explanatory Notes on Essentially Derived Varieties (EDV). These new notes replaced the version of 2017. In general terms, it can be said that the “umbrella” or scope of protection of the right of the initial variety has been increased.
New version Explanatory Notes on Essentially Derived Varieties
The new Explanatory Notes provide clarification regarding the following subjects:
- Mutants are per se predominantly derived from the initial variety. This concerns both natural mutants and genetically modified mutants.
- There is no maximum number of differences in characteristics between the initial variety and those of the EDV, which have arisen as a result of plantbreeding.
- If there is a new characteristic resulting from the breeding of the (initial) variety, this can also be a "substantial/essential characteristic". This means that if a essentially derived variety differs from the initial variety in 1 or more important characteristics (e.g., a valuable resistance), this essentially derived variety does not fall outside the scope of the initial variety.

Nieuwe versie Explanatory Notes on Essentially Derived Varieties
Na een discussie van ruim 4 jaar is op 27 oktober 2023 door de Council van UPOV een nieuwe versie van de Explanatory Notes on Essentially Derived Varieties (EDV) vastgesteld. Dit exemplaar vervangt de versie uit 2017. In algemene zin kan gesteld worden dat de “paraplu” of de reikwijdte van de bescherming van het recht van het initiële ras is toegenomen.
Nieuwe versie Explanatory Notes on Essentially Derived Varieties
De nieuwe Explanatory Notes geven verduidelijking t.a.v. de volgende onderwerpen:
- Mutanten zijn per definitie “hoofdzakelijk afgeleid” van het initiële ras. Dit geldt zowel voor natuurlijke mutanten als genetisch gemodificeerde mutanten.
- Er is geen maximumaantal verschillen in kenmerken tussen het initiële ras en die van de EDV, die zijn ontstaan als gevolg van de veredeling.
- Als er sprake is van een nieuw kenmerk dat het gevolg is van de veredeling van het (initiële) ras, dan kan dit ook een “wezenlijk/essentieel kenmerk” zijn. Dit betekent dat als een hoofdzakelijk afgeleid ras in 1 of meer belangrijke kenmerken (bijv. een waardevolle resistentie) verschilt van het initiële ras, dit afgeleide ras niet buiten de scope valt van het initiële ras.
