Patentrechte im Bereich der Pflanzenzucht sollen neu offengelegt werden müssen. Züchterinnen und Züchter erhalten damit mehr Sicherheit beim Züchten neuer Sorten. Der Bundesrat hat am 9. September 2026 die Vernehmlassungsergebnisse zur Kenntnis genommen und die Botschaft zur Änderung des Patentgesetzes zuhanden des Parlaments verabschiedet.

Pflanzenzüchterinnen und Pflanzenzüchter nutzen häufig eine bestehende Sorte als Ausgangspunkt für die Entwicklung neuer Sorten. Ist eine bestimmte Eigenschaft dieser Sorte durch ein Patent geschützt, wie zum Beispiel eine Resistenz gegen Fäule, brauchen sie für die Vermarktung der neuen Sorte in der Regel eine Lizenz. Ob das der Fall ist, lässt sich jedoch oft nicht ohne Weiteres feststellen. Diese Unsicherheit kann die Pflanzenzucht erschweren und damit Innovation hemmen.

Transparenz für Züchterinnen und Züchter

Die Vorlage führt deshalb eine Offenlegungspflicht ein: Anmelderinnen oder Inhaber eines Patents auf biologisches Material einer Pflanzensorte müssen in einer Datenbank offenlegen, welche Sorten über die patentierte Eigenschaft verfügen. Züchterinnen und Züchter können sich so auf einfache Weise über relevante Patente informieren und Entscheidungen für ihre Züchtungsprogramme treffen.

Wird die Offenlegungspflicht nicht eingehalten, können Anmelderinnen und Inhaber ihr Patent gegenüber Züchterinnen und Züchtern nicht geltend machen. Das schützt jene Züchterinnen und Züchter, die sich rechtzeitig informiert haben.

Die Vorlage präzisiert ausserdem, wie weit ein Patent auf eine Eigenschaft reicht: Der Schutz kann nicht geltend gemacht werden, wenn Züchterinnen und Züchter dieselbe Eigenschaft unabhängig von patentiertem biologischem Material und ausschliesslich durch konventionelle Züchtung entwickeln.

An EU-Regelung angelehnte Lösung

Die gewählte Lösung stützt sich auf bestehende, freiwillige Transparenzinitiativen des Sektors. Das ermöglicht eine einfache und rasche Umsetzung. Sie orientiert sich zudem an den Entwicklungen in der EU. Diese Angleichung erleichtert grundsätzlich den Zugang schweizerischer Züchterinnen und Züchter zum europäischen Markt.

In der Vernehmlassung wurden Vorbehalte gegen die vorgeschlagene Clearingstelle und dem damit verbundenen administrativen Aufwand geäussert. Der Bundesrat hat daher darauf verzichtet.

Davantage de sécurité juridique dans le domaine de la sélection végétale

L’instauration d’une nouvelle obligation de divulgation des brevets intervenant dans la sélection des plantes va être proposée. Elle vise à donner davantage de sécurité juridique aux obtenteurs. Le 9 septembre 2026, le Conseil fédéral a pris acte des résultats de la procédure de consultation et adopté le message concernant la révision de la loi sur les brevets à l’attention du Parlement.

Les obtenteurs utilisent souvent une variété existante comme point de départ pour le développement de nouvelles variétés. Lorsqu’une caractéristique de cette plante, comme la résistance contre la pourriture, est protégée par un brevet, ils doivent obtenir une licence du titulaire du brevet s’ils entendent commercialiser la nouvelle variété végétale. Cependant, il n’est souvent pas aisé de déterminer si une caractéristique est protégée par un brevet. Cette insécurité peut compliquer la sélection végétale et freiner l’innovation.

Transparence pour les obtenteurs

C’est pourquoi le projet de révision de la loi sur les brevets prévoit d’instaurer une obligation de divulgation. Le demandeur ou le titulaire d’un brevet portant sur le matériel biologique d’une variété végétale devra indiquer dans une banque de données quelles variétés disposent de la caractéristique brevetée. Les obtenteurs pourront ainsi s’informer facilement sur les brevets pertinents et prendre des décisions éclairées pour leurs programmes de sélection.

Si les demandeurs ou les titulaires de brevet manquent à leur obligation, ils ne pourront pas opposer leur brevet aux obtenteurs. Cette mesure protègera les obtenteurs qui se seront renseignés en temps utile.

Le projet législatif précise en outre la portée d’un brevet portant sur une caractéristique. Le demandeur ou le titulaire du brevet ne pourra pas faire valoir son droit si l’obtenteur développe la même caractéristique indépendamment du matériel biologique breveté et exclusivement par des procédés de sélection conventionnels.

Une solution qui s’inspire de la réglementation de l’UE

La solution retenue s’appuie sur des initiatives facultatives favorisant la transparence qui existent déjà dans le secteur de la sélection végétale, ce qui accélèrera et simplifiera sa mise en œuvre. Elle s’inspire en outre des évolutions intervenues dans l’UE. Cette harmonisation avec à la réglementation européenne facilitera l’accès des obtenteurs suisses à ce marché.

Au cours de la consultation publique, des réserves à l’encontre de la création d’un service de clearing et de la charge administrative qu’il aurait générée ont été formulées, raison pour laquelle le Conseil fédéral a abandonné cette approche.

Maggiore certezza del diritto nella selezione vegetale

Da ora in poi ai diritti di brevetto nel settore della selezione vegetale si applicherà un obbligo di divulgazione, il quale permetterà ai costitutori di beneficiare di una maggiore sicurezza nello sviluppo di nuove varietà. Nella seduta del 9 settembre 2026 il Consiglio federale ha preso atto dei risultati della consultazione e ha adottato il messaggio concernente la revisione della legge federale sui brevetti all’attenzione del Parlamento.

Nel settore della selezione vegetale spesso i costitutori usano varietà vegetali esistenti come punto di partenza per svilupparne di nuove. Se determinate proprietà presenti nelle varietà utilizzate sono protette da brevetti, ad esempio una resistenza alla decomposizione, di regola il costitutore deve ottenere una licenza dal titolare del brevetto per poter commercializzare la nuova varietà. Tuttavia, non è sempre facile reperire le informazioni necessarie. Questa insicurezza può complicare la selezione vegetale e frenare l’innovazione.

Trasparenza per i costitutori

Alla luce di ciò il progetto di revisione introduce un obbligo di divulgazione: il depositante o il titolare di un brevetto avente per oggetto il materiale biologico di una varietà vegetale deve indicare, in una banca dati, quali varietà presentano proprietà brevettate. I costitutori possono così informarsi facilmente sui brevetti pertinenti e prendere decisioni per i loro programmi di selezione vegetale.

In caso di inosservanza di tale obbligo, i depositanti e i titolari non possono far valere il loro brevetto nei confronti dei costitutori. Ciò tutela i costitutori che si sono informati tempestivamente.

Il progetto legislativo precisa altresì la portata degli effetti del brevetto su una proprietà: la protezione non può essere fatta valere se i costitutori sviluppano la stessa proprietà a prescindere dal materiale biologico brevettato ed esclusivamente con procedimenti convenzionali.

Una soluzione in linea con la regolamentazione dell’UE

L’opzione scelta si basa su iniziative di trasparenza settoriali esistenti intraprese su base volontaria e consente quindi un’attuazione facile e veloce. Si orienta, inoltre, agli sviluppi in seno all’UE, facilitando in linea di principio l’accesso dei costitutori svizzeri al mercato europeo.

Nel quadro della procedura di consultazione sono state espresse riserve sull’introduzione di un servizio di clearing e sul relativo onere amministrativo. Il Consiglio federale ha quindi deciso di non introdurlo.

Greater legal certainty in plant breeding

Patents relating to plant breeding are to be disclosed in future. This will give breeders greater certainty in their breeding of new varieties. On 9 September 2026, the Federal Council acknowledged the results of the consultation and adopted the dispatch on the revision of the Patents Act for submission to Parliament.

Plant breeders often use an existing variety as the basis for developing new ones. If a given characteristic of the existing variety, such as rot resistance, is protected by a patent, the breeder will generally need a licence to market the new variety. It is often difficult for breeders to work out whether they need a licence or not. This lack of certainty can make plant breeding more difficult and thus hinder innovation.

Transparency for breeders

The draft therefore introduces a disclosure obligation: anyone who applies for or owns a patent on biological material relating to a plant variety will now be required to disclose in a database which varieties possess the patented characteristic. This will enable breeders to easily find out about relevant patents and make decisions regarding their breeding programmes.

If the disclosure requirement is not observed, patent applicants and owners will be unable to exercise their patent right with respect to breeders. This will protect those breeders that obtain the relevant information in good time.

The draft also stipulates the scope of a patent on a characteristic: protective rights cannot be asserted if breeders develop the same characteristic without using patented biological material and solely by means of conventional breeding.

Solution based on EU rules

The selected solution is based on existing voluntary transparency initiatives in the sector. Hence, it will be quick and easy to implement. It is also in line with the developments in the EU, which will make it easier for Swiss breeders to access the European market.

During the consultation, reservations were expressed about the proposed clearing house and the related administrative work. As a result, the Federal Council has decided not to pursue that proposal.
